Greece – Guidance and Regulations

Please ensure that you review the Regulator Website: www.eett.gr, so that you are familiar with the regulatory requirements in Greece.

Campaign

The landing page must have the following elements visible, without expanding or scrolling down the page.

  • The service name
  • Whether it is a subscription
  • The cost of the service and the frequency, e.g. €27.48 per month
  • The opt-out details, clear instructions on how to do this
  • Recommended wording for the button on the MSISDN entry page: Συνέχεια
  • Our company name as the shortcode owner, including postal address and customer care phone line. 
    • In order to cover this requirement, the following text needs to be added in a spot that will be visible by all consumers without expanding or scrolling down the page (e.g. top of the page), for example:

Since design constraints sometimes make this tricky (including on mobile-targeted designs), we strongly suggest putting the phrase above at the top of the page. It can also be part of a graphic near the top of the page, as long as it's easily readable and visible without scrolling. The "<More terms link>" should scroll down to the disclaimer terms mentioned below. If there is a separate terms page, you must have a separate link in the disclaimer terms.

  • The following phrase needs to be added to your landing page disclaimer terms. It can be anywhere in the terms, but since it talks about extra fees you may want to place it close to the price within the footer. (This line is already included in the text displayed above).

The Landing page must:

  • Show sufficiently the subscription service's recurring/ongoing provided content/benefit.
  • Not confuse the user into thinking they will win something just by entering (competition).
  • Not confuse a single download / action with joining a subscription.
  • Not require the user to join/subscribe to get results of questions.
  • If it has teaser questions:
    • Any wrong answer must clearly indicate to the user that it's wrong and not allow the consumer to proceed until they select the correct one.
    • The right answer, when selected, must clearly indicate to the user that it was correct.
    • The user must not get the idea that they must subscribe in order to receive the answers.
  • The service must have an unchecked tick box in the MSISDN or PIN entry form, that is required to be checked, with the following text next to it:

  • Optionally have a working link to further/general terms and conditions page

Please note that the service must not automate any part of the user's opt in, including pre-filling the MSISDN, the PIN or replying to any messages on the consumers behalf.


Disclaimer / Footer Terms

The landing page disclaimer terms must be visible, at least the first 2 lines without the user having to scroll to view them. They must include:

  • Details on how the charging is done by receiving messages from all applicable short codes and how there is a cost for each message
  • The user must be the owner of device or have the permission from the bill payer
  • Extra carrier charges may apply
  • Explain downscaling possibility
  • Confirm the subscription frequency, e.g. weekly / monthly
  • If applicable, explain prize entries and any draws that users will take part in for competitions
  • If the service is only available for a limited period
  • Include the full details of the partner, company and Shortcode provider 
  • Include the customer care info, phone line and optional email

Example of Disclaimer Terms for a Subscription Service

GR: Η υπηρεσία {SERVICE NAME & DESCRIPTION OF SERVICE} Όταν γίνεται η εγγραφή σε αυτή την υπηρεσία και λαμβάνετε δωρεάν μήνυμα το οποίο αποστέλλεται στο κινητό σας τηλέφωνο και περιέχει όλες τις πληροφορίες των υπηρεσιών, αναγνωρίζετε και συμφωνείτε ότι θα είστε συνδρομητές της υπηρεσίας {SERVICE NAME}. Please note - You must not attempt to send zero rated or billable messages to users during the "unsociable hours" of 23:30 and 7:00.

Message Flow

All messages sent to the consumer must be in the local language – Greek. The messages should include the service name and contact details. The content message must include the service name and how to access the content, for example via a unique URL.

Billed 

As you will be sending multiple billed messages (3), you need to make them different, so that the consumer understands that all messages are required. For example;

  • Message 1 - GR: {Service name} ΑΠΟΛΑΥΣΤΙΚΟ ΚΑΙ ΔΙΑΣΚΕΔΑΣΤΙΚΟ ΠΕΡΙΕΧΟΜΕΝΟ ΒΡΙΣΚΕΤΑΙ ΤΩΡΑ ΣΤΗ ΔΙΑΘΕΣΗ ΣΟΥ. ΚΑΝΕ ΚΛΙΚ ΣΤΟ xxxxxxxx

Please ensure that you include the service name and content link (if applicable) in each message.

Reminder - This must be sent once a month:

  • EN example (must be Greek) - {Service name}. This subscription service costs {insert cost per week or message price and frequency}. To cancel send the word STOP to {short code}. Support: {Insert your customer service number}.

Customer care / Refund Policy

All service providers must have a detailed customer care process and refund policy in place.

You need to ensure that a process is in place for consumers to gain help should they require it, along with a refund policy for those that require one or are eligible for a refund.

This will be discussed in detail, to ensure that our customer care team can resolve any queries that are received from the networks or regulator.
